  • Engaging in thorough preliminary fact-finding and drafting complaints that set the proper tone for a case

 

  • Producing and reviewing discovery materials; using those materials effectively in conferences, correspondence, and motion practice

 

  • Drafting strategically chosen motions and letters to the Court seeking to compel the production of additional relevant evidence

 

  • Drafting cordial but forceful correspondence with opposing counsel

 

  • Taking efficient and productive depositions; preparing a client's witnesses for depositions


  • Issuing and overseeing compliance with third-party subpoenas, or fighting compliance with such subpoenas where appropriate

 

  • Effectively marshalling relevant law and allegations/facts in order to draft persuasive motions to dismiss and motions for summary judgment


  • Successfully moving to vacate legally erroneous decisions (particularly after previous counsel withdraws or is terminated); successfully moving to amend pleadings after taking over for prior counsel


  • Appealing district court errors to the federal appellate courts (especially in the areas of copyright and trademark law)


  • Negotiating favorable settlements where preferable to continued litigation
